Biography

Adam Zaffos brings over 20 years of complex litigation experience to the Firm. Prior to joining Fernald & Zaffos, he was a senior litigator with The Wonderful Company—a privately held food conglomerate with such brands as FIJI Water, POM Wonderful, Justin Wines, Wonderful Pistachios and Almonds (Get Crackin’ Pistachios) and Wonderful Citrus (Cuties/Halos).

While there, he managed all aspects of litigation and risk management from inception to resolution and chaired or co-chaired multiple trials and arbitrations involving hundreds of millions of dollars.  His complex practice included false advertising, unfair competition, class actions, regulatory dispute (FTC), antitrust, intellectual property, employment, bankruptcy and business litigation.

Prior to that, Adam spent two years with the international law firm of Hogan Lovells where he focused on antitrust litigation, primarily for Fox News Corporation and Fox Entertainment Group.  Before that, he practiced almost six years in the Los Angeles office of Norton Rose Fulbright, one of the largest law firms in the world.  While there, he focused on complex class action and mass tort litigation.

Adam was admitted to practice law in the state of California in 2001.  He is admitted to practice before the United States District Courts for the Central, Eastern, Southern and Northern Districts of California, the Ninth Circuit Court of Appeals, as well as the United States Supreme Court.

  • Represented employee in lawsuit against national, athletic clothing retailer in a sexual harassment and assault lawsuit. Following extensive discovery, Adam was able to obtain a very favorable settlement for the client.
  • Represented employee in lawsuit against US affiliate of a global shipping and document management firm arising out of sexual harassment and assault. Following extensive discovery, including 7 depositions out of state, Adam obtained a very favorable settlement for the client.
  • Represents and advises a variety of companies in the precious metal space on employment and unfair competition matters.
  • Recently obtained a multi-million dollar verdict in a real estate fraud dispute pending in the Los Angeles Superior Court.
  • Represented pomegranate juice maker in FTC false advertising regulatory action and concurrent class action which resulted in dismissal of class action and avoidance of monetary penalties in FTC action.
  • Represented pomegranate juice maker in United States Supreme Court writ that resulted in the landmark decision that false advertising claims are not bounded by the rules promulgated by the FDA.
  • Represented pistachio grower and processor in multi-million-dollar tort and antitrust actions against it from a competitor. Successfully resolved all cases on either summary judgment or directed verdict.
  • Represented vineyard in $25 million breach of contract action resulting in a fractional verdict of just $400k against the vineyard.
  • Represented large satellite TV provider from a competitor in a multi-billion satellite piracy and business disruption case. Resulted in a favorable verdict to the client.
  • Represented large pharmaceutical company in nationwide products liability lawsuits against it and other pharmaceutical companies for alleged unsafe product. Resulted in across the board defense verdicts for the client.
